SMS Messaging Consent

Dispute Resolution and Pre-Arbitration Process
A. Informal Resolution
Before initiating any formal dispute resolution process, you agree to first contact Front Line Moving and Storage LLC at the contact information below to attempt an informal resolution of any dispute, claim, or controversy arising out of or relating to these Terms or our services (“Dispute”). The parties agree to use reasonable efforts to resolve the Dispute informally within thirty (30) days after written notice.
B. Mandatory Mediation
If the Dispute is not resolved informally, the parties agree to submit the matter to mediation administered by a mutually agreed-upon mediator. Mediation shall be conducted in a manner and location mutually acceptable to both parties, with costs shared equally.
C. Binding Arbitration
If mediation does not resolve the Dispute within sixty (60) days following its initiation, the Dispute shall be exclusively resolved by binding arbitration:
Administration: Arbitration will be administered by the American Arbitration Association (AAA) in accordance with its then-current Commercial Arbitration Rules, except where consumer rules apply.
Scope: Any arbitration involving less than $50,000 in controversy shall be conducted solely on an individual basis, not as a class or consolidated action.
Location: The arbitration shall be held in Orange County, California.
Finality: The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
D. Costs and Fees
Each party shall bear its own costs and fees related to negotiation, mediation, or arbitration, except that the prevailing party in arbitration may be awarded reasonable attorney’s fees and costs as determined by the arbitrator.
E. Confidentiality
All aspects of the dispute resolution process, including mediation and arbitration proceedings, shall remain confidential and shall not be disclosed to any third party except as required by law or necessary to enforce the arbitration award.
F. Class Action Waiver
To the fullest extent permitted by law, all dispute resolution proceedings shall be conducted on an individual basis and not as a class action or any other form of representative proceeding.
G. Survival
This dispute resolution clause shall survive termination or expiration of these Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions. Any legal action arising from these Terms shall be exclusively brought in the state or federal courts located in Orange County, California.
Changes to Terms
We reserve the right to modify or update these Terms at any time. All changes will be effective immediately upon posting on the Website. Your continued use of our Website and services after such modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
Cancellation Policy
Front Line Movings & Storage LLC understands that plans may change; however, due to scheduling commitments and operational costs, the following cancellation terms apply.
Cancellations made more than 72 hours after the initial reservation are not eligible for a refund. In addition, cancellations made within ten (10) business days of the originally scheduled move date are also non-refundable.
For cancellations that qualify for a refund, the refunded amount will be subject to deductions, including an administrative fee of eleven percent (11%) of the total amount paid, as well as a non-refundable charge of $1.00 per cubic foot based on the estimated volume of the move.
Upon cancellation, documentation confirming the termination of services will be provided for your review and signature. This documentation will outline the cancellation details and specify any applicable refunds and/or credits. Execution of such documentation is required to finalize the cancellation and release both parties from further financial obligations under the agreement.
